AI Audit & Regulatory Readiness for Financial Services

EU AI Act Compliance Audits | AI Governance Reviews | BaFin Examination Readiness | DORA Risk Assessments | Remediation

Is Your Financial Institution Ready for AI Regulatory Scrutiny?

Artificial intelligence is increasingly embedded in the operations of banks, insurance companies, asset managers, investment firms, payment institutions and other financial services providers.

From creditworthiness assessments and insurance pricing to fraud detection, anti-money laundering, investment management and generative AI, these applications introduce new opportunities — but also regulatory obligations, operational risks and supervisory expectations.

The critical question is no longer simply whether your organisation uses AI. It is whether you can demonstrate that your AI systems are governed, controlled and compliant with applicable regulatory requirements.

The European Union’s Artificial Intelligence Act (EU AI Act), Germany’s AI Market Surveillance and Innovation Promotion Act (KI-MIG) and the Digital Operational Resilience Act (DORA) establish an increasingly important regulatory framework for financial institutions.

Under Germany’s KI-MIG, the Federal Financial Supervisory Authority (BaFin) is responsible for market surveillance of specified AI systems directly connected with regulated financial activities.

Leitner & Associates, a professional service of Andreas Leitner GmbH, provides specialist AI audits, regulatory readiness assessments, compliance gap analyses and examination preparation for the financial services industry.

We help financial institutions identify regulatory deficiencies, evaluate the effectiveness of AI governance and internal controls, prepare for supervisory examinations and implement appropriate remediation measures.

Identify regulatory gaps. Strengthen internal controls. Prepare for supervisory scrutiny.

Our AI Audit & Regulatory Readiness Services

Our audit and assessment services evaluate whether your organisation’s AI applications, governance arrangements, risk management processes and internal controls meet applicable regulatory requirements.

We combine regulatory analysis with practical assessments of governance, processes, documentation and control effectiveness.

1. EU AI Act & KI-MIG Readiness Assessment

Understand your regulatory obligations and identify compliance gaps.

The EU AI Act introduces obligations that depend on the intended purpose, risk classification and operator role associated with individual AI systems.

Our EU AI Act Readiness Assessment examines your organisation’s current position against applicable requirements.

The assessment covers:

  • Identification and inventory of AI systems and applications
  • Assessment of AI Act applicability and regulatory scope
  • Classification of AI systems under Article 6 and the relevant annexes
  • Determination of provider, deployer and other relevant operator responsibilities
  • Assessment of prohibited AI practices under Article 5
  • Review of AI literacy arrangements under Article 4
  • Assessment of applicable transparency requirements under Article 50
  • Identification of relevant high-risk AI requirements
  • Evaluation of existing governance policies, procedures and controls
  • Identification of regulatory gaps and implementation priorities

Deliverables: AI Act applicability assessment, regulatory requirements matrix, compliance gap analysis, prioritised findings register and implementation roadmap.

Your benefit: A documented understanding of the AI Act requirements applicable to your organisation, existing compliance deficiencies and the actions required to address them.

2. AI Governance & Internal Control Audit

Assess whether your AI governance framework is properly designed, documented and operating effectively.

Effective AI governance requires more than an AI policy or an inventory of applications. Financial institutions need appropriate organisational structures, clearly allocated responsibilities, effective risk management and reliable internal controls.

Our AI Governance Audit examines the design and, where agreed, operational effectiveness of your organisation’s AI governance framework.

Key assessment areas include:

  • AI strategy and governance framework
  • Responsibilities of management bodies and control functions
  • AI policies, guidelines and internal procedures
  • AI system inventory and lifecycle management
  • AI risk assessment and classification methodologies
  • Risk appetite, risk acceptance and escalation procedures
  • AI development, procurement and deployment approvals
  • Model governance, testing and validation arrangements
  • Human oversight and intervention procedures
  • Data governance, data quality and bias risk controls
  • Generative AI and large language model governance
  • Internal control design and operating effectiveness
  • Management information, monitoring and reporting

We examine how AI-related responsibilities are integrated into existing governance arrangements, including Compliance, Risk Management, Information Security, ICT and Internal Audit.

Deliverables: AI governance audit report, risk and control matrix, control deficiencies register, management recommendations and corrective action plan.

Your benefit: A structured assessment of governance and control effectiveness, supported by clear findings and recommendations for improvement.

3. High-Risk AI Compliance & Readiness Audit

Prepare for the specific regulatory requirements applicable to high-risk AI systems.

Certain AI applications in the financial services industry are classified as high-risk under Annex III of the EU AI Act.

These include, subject to the relevant legal conditions and exceptions:

  • AI systems intended to evaluate the creditworthiness of natural persons or establish their credit scores, excluding systems used for detecting financial fraud.
  • AI systems intended for risk assessment and pricing concerning natural persons in life and health insurance.

High-risk AI systems are subject to additional regulatory requirements, depending on the relevant operator’s role.

Our High-Risk AI Compliance Audit examines:

  • High-risk classification and applicable exemptions
  • Provider and deployer responsibilities
  • AI risk management systems
  • Data governance and data quality arrangements
  • Technical documentation and record-keeping
  • Transparency and information obligations
  • Human oversight arrangements
  • Accuracy, robustness and cybersecurity controls
  • Conformity assessment and registration requirements, where applicable
  • Post-deployment and post-market monitoring
  • Serious-incident reporting arrangements
  • Fundamental rights impact assessments where required under Article 27

Deliverables: High-risk AI requirements matrix, compliance assessment report, documentation review, control checklist and prioritised remediation plan.

Your benefit: Greater clarity regarding high-risk AI obligations and a practical basis for implementing the required governance, documentation and controls.

4. AI & DORA Compliance Audit

Integrate AI-related ICT risks into your existing digital operational resilience framework.

Artificial intelligence creates specific information and communication technology (ICT) risks throughout the AI system lifecycle.

These risks may arise from data acquisition, model development, system deployment, operational dependencies, external AI service providers, cybersecurity vulnerabilities and changes to AI systems.

The Digital Operational Resilience Act (DORA) establishes ICT risk management and operational resilience requirements for financial entities within its scope.

In December 2025, BaFin published non-binding guidance on ICT risks arising from the use of artificial intelligence in financial institutions.

Our AI & DORA Compliance Audit examines how AI-related ICT risks are addressed within your existing DORA arrangements.

Assessment areas include:

  • Identification and classification of AI-related ICT assets
  • Integration of AI risks into the ICT risk management framework
  • AI-related information security and cybersecurity controls
  • ICT third-party risk management
  • AI and cloud service provider dependencies
  • Contractual arrangements and relevant audit rights
  • Testing, validation and change management
  • Access controls and protection of information assets
  • ICT incident detection, management and reporting
  • Business continuity, resilience and recovery arrangements
  • AI system monitoring and decommissioning
  • Governance, documentation and management reporting

Deliverables: AI-related ICT risk assessment, DORA compliance gap analysis, third-party risk assessment, control testing report and remediation roadmap.

Your benefit: A coordinated approach to AI governance and ICT risk management that builds on existing DORA arrangements and avoids unnecessary duplication.

5. BaFin AI Examination Readiness Review

Prepare your organisation, documentation and control environment for regulatory examinations.

The KI-MIG, which entered into force on 29 July 2026, assigns BaFin market surveillance responsibilities for specified AI systems directly related to regulated financial activities undertaken by designated supervised entities.

Financial institutions must therefore consider how they can demonstrate compliance with applicable AI Act requirements, alongside their existing supervisory obligations.

Our BaFin AI Examination Readiness Review is designed to assess whether your organisation can provide appropriate evidence of its AI governance, risk management and compliance arrangements.

We review:

  • Organisational responsibilities and management oversight
  • AI inventories and regulatory classifications
  • Documentation supporting regulatory assessments
  • AI governance policies and procedures
  • AI risk assessments and control documentation
  • High-risk AI compliance evidence, where relevant
  • DORA integration and ICT risk management evidence
  • Third-party AI service provider oversight
  • AI literacy and training records
  • Internal audit findings and outstanding deficiencies
  • Remediation plans and evidence of corrective action
  • Management reporting and supervisory information readiness

Where appropriate, we conduct structured examination simulations, documentation walkthroughs and interviews with relevant business and control functions.

Deliverables: Examination readiness report, evidence checklist, document request list, findings register, management briefing and prioritised remediation plan.

Your benefit: Improved preparation for regulatory information requests and examinations, with an evidence-based assessment of potential weaknesses.

Our readiness reviews do not constitute official BaFin examinations or guarantee a particular supervisory outcome.

6. AI Compliance Remediation & Effectiveness Review

Resolve deficiencies and demonstrate that corrective measures have been implemented effectively.

Identifying compliance gaps is only the beginning. Financial institutions must also implement corrective actions and, where relevant, demonstrate their effectiveness.

Leitner & Associates supports institutions in addressing deficiencies identified through internal audits, compliance reviews, regulatory assessments and supervisory examinations.

Our services include:

  • Assessment and prioritisation of audit findings
  • Root cause analysis of governance and control deficiencies
  • Development of corrective action and remediation plans

Frequently Asked Questions About AI Audits & Regulatory Readiness

What is an EU AI Act audit?

An EU AI Act audit is a structured assessment of an organisation’s AI-related activities, governance, processes, documentation and controls against applicable requirements of the EU Artificial Intelligence Act.

Its scope may include regulatory classification, provider and deployer responsibilities, AI literacy, transparency, high-risk AI obligations, governance and control effectiveness.

An external compliance audit does not automatically constitute a statutory conformity assessment or certification under the AI Act.

Are banks and insurance companies required to conduct AI audits?

The EU AI Act does not establish a universal requirement for every bank or insurer to commission a standalone external AI Act audit.

However, institutions must meet applicable AI Act obligations and relevant financial-sector governance and control requirements. DORA also establishes specific ICT risk management, review and audit requirements for financial entities within its scope.

A risk-based AI audit can help institutions assess compliance and identify deficiencies before regulatory examinations.

What is an AI Act Readiness Assessment?

An AI Act Readiness Assessment evaluates an organisation’s current compliance position against applicable AI Act requirements.

It typically includes an inventory review, regulatory applicability assessment, risk classification, governance evaluation, documentation review, gap analysis and prioritised remediation roadmap.

What role does BaFin play in AI supervision?

Under § 2(3) KI-MIG, BaFin is the competent market surveillance authority for specified AI systems directly connected with regulated financial activities involving designated BaFin-supervised financial institutions.

Other authorities may be responsible for AI systems outside this statutory scope.

How does an AI audit differ from a DORA audit?

An EU AI Act audit primarily assesses AI-specific regulatory obligations, including classification, transparency, human oversight and relevant high-risk AI requirements.

An AI-related DORA audit focuses on applicable ICT risk management, information security, operational resilience and ICT third-party risk requirements.

The assessments overlap in areas such as cybersecurity, governance, suppliers and operational controls. An integrated approach can improve efficiency and reduce duplication.

Are all AI systems used by financial institutions classified as high-risk?

No. The AI Act uses a risk-based classification framework.

Certain creditworthiness assessment and life and health insurance applications are specifically identified in Annex III, subject to applicable conditions and exceptions.

Other applications, including fraud detection, anti-money laundering, generative AI and internal process automation, must be assessed according to their intended purpose and relevant legal requirements.

What documentation is required for AI regulatory examinations?

Documentation depends on the institution’s role, regulatory status and AI systems.

Potentially relevant evidence includes AI inventories, risk classifications, governance policies, risk assessments, control documentation, training records, third-party assessments, monitoring records and remediation reports.

Additional documentation requirements may apply to specific high-risk AI systems.

Can Leitner & Associates review the effectiveness of completed remediation measures?

Yes. We can assess whether corrective actions have been implemented and whether relevant controls are appropriately designed and operating effectively, within the agreed review scope.

Where formal independence is required, this must be considered when defining the engagement.
